This talk is titled "The state of software patents in 2022," and was presented at LibrePlanet 2022 by Panos Alevropoulos. What's the deal with software patents? Have you ever wondered what's at stake, how much money is changing hands or who's at risk? Maybe you heard that piece on NPR and have been wondering how software patents impact free and open source projects specifically. I'll go over how the US patent system got to where it is in relation to software in particular. Find out what's already been tried and what's currently being done to protect free operating systems. Lastly, I'll cover some of the defensive strategies, like Prior Art and Defensive Publications that can help defend Linux, GNU and related projects. Of particular interest to free software contributors, this talk also has plenty of big picture information to make it interesting for free software activists and users.

In the next few days, the legal affairs (JURI) Committee of the European Parliament will discuss on the next actions regarding the project for a unitary patent. Behind what looks like a technical text lies a crucial issue: who decides on what is patentable and what is not. As software patents are coming back in international news with the Apple/Samsung case, we need to ensure that such aberrations cannot happen in Europe. We calls for a general mobilisation to contact all MEPs, so that the European Parliament finally tackles the issue of the software patentability. Have we silently lost the battle against software patents in Europe? In July 2005, after several failed attempts to legalise software patents in Europe, the patent establishment changed its strategy. On 2005-05-18 Richard Stallman visited University of Calgary to talk about the dangers of software patents. Hosted by Calgary UNIX Users Group. ... RMS makes a few references specific to Canada, but most of his talk is applicable to any country. ... This footage was recorded in HD 1280x720x30p at 16x9. I have pan/scanned it to fill a 4:3 frame. For talking head footage, didn't see any point in uploading HD resolution footage. And IA isn't generating properly formatted derivatives of 16:9 (anamorphic) MPEG-2 footage yet. ... Audio was recorded onto an iRiver MP3 player/recorder (iFP-790) with an external passive microphone plugged in. There's a couple shots you can see it sitting on the table in front of RMS. Syncronized it with video in post. I find the iRiver a great way to capture audio, but an external microphone is needed as the iRiver tends to clip waveforms. The incoming volume control does NOT work for the built in mic, and the levels are too loud for any practical use. Darn shame. ... If anyone has need of the original HD footage, let me know. I can pull it off the camera and post small clips of the raw footage to IA if particular segments are good to anyone. The 16:9 might cut off less of RMS at times too (I was lazy when pan/scanning). Too darn big to post the whole HD thing. Segments with missing footage are exactly that. I was switching tapes or the STUPID JVC copy-from-camera-to-hard-drive program clipped my footage. If you need a missing piece, I'll see what I can do, or CUUG will probably have a 720x480 copy off someone else's camera. ... If you're listening to the MP3 or OGG ... the long silent pauses are RMS drinking Pepsi.

The Software Patents Directive was the second largest lobbying effort that the European Union has seen. After two years of work on this directive, and now that the directive has been rejected, IFSO would like to look back on what was achieved and why it was so important to so many people. Attendees will hear how the EU legislative process worked in practice, who was represented in the process, and who wasn't. The seminar will also look at the road ahead for the software patents battle in the EU. While this attempt at introducing software patents has been decisively blocked, the exclusion of software ideas from patentability still has to be hardened. Until then, we will face attempts to get software patents in through the back door. Some such attempts are already under way. Finally, the broader implications will be looked at, for related legislation which adds unnecessary risks and costs to the development and distribution of software. By making it impractical for smaller companies and individuals to participate in the development and distribution of software, such legislation stands to benefit the current market leaders at the cost of competition and freedom.
