1- INTRODUCTION As one of the historical, social and religious achievements, the Waqf institution has a significant position in the social system and its capacities can be used to develop economic convergence in the society. Humanity seems to be a very complicated task. However, despite the fact that the common thread of all these debates is on the topic of endowment, it seems that explaining the concept of endowment property with the transformation and evolution of societies, especially from the economic point of view, and also the emergence of new properties in the economic market. To some extent, the feasibility of endowment of any property has confused the opinions of jurists and jurists, and in this respect, there has been a difference of opinion regarding the capacities of the endowment institution and modern economic relations. Nowadays, one of the important interdisciplinary topics is the adaptation of the Waqf institution with economic rights. First of all, there should be poems that explain the position and juridical and legal nature of securities as a financial instrument, which sometimes indicates the ownership position of a person in general in the stock market (stocks) and sometimes indicates a creditor relationship from a government institution or company (partnership bonds). and sometimes it is a representative of property rights that is shown as the option to buy and sell.In this article, the paper of securities as a financial and economic tool that has a more general concept of endowment of shares in the stock exchange has been processed, which in addition to the theoretical value of the subject and the detailed follow-up on the subject in jurisprudence and law has a lot of practical value, including the most important The cases are to know the position and role of legal transfer and the legal nature of the transactions and contracts that are carried out in relation to the mentioned papers. In other words, merely analyzing and examining the nature of these securities, based on the foundations of Western law, and ignoring the foundations of principles, rules, institutions, and new and innovative institutions in Islamic law will not fully and comprehensively comply with the subject. Moreover, it will not lead to an accurate understanding of the nature of securities. On the other hand, it is necessary to know the nature of the transfer contract and the transactions of these securities also do not guide it to the right path. Therefore, the necessity of discussing the appropriateness of the institution of endowment for the transfer of ownership and endowment for the existing value of the securities should be evaluated. For this purpose, many legal experts, in order to pay attention to the precise and comprehensive foundations of the new issues in the Imamiyyah jurisprudence, have only followed the path of western legal teachings and in order to understand the legal nature of securities, they have been converted into a kind of imitation, and from this point of view, no effort is made to conform These documents did not create the foundations of Islamic law. but, it should not be assumed that the endowment institution should only belong to Islamic societies. Because the nature of the endowment institution is in line with the standards in modern economic law, such as the theory of economic functionalism, and as if there is a common understanding of the endowment institution among human societies. Among these institutions and related legal mechanisms will help the progressive development process. 2- PURPOSE Since the institution of Waqf has a long history and in addition to the existence of this legal and economic institution in Islamic countries, in the developed countries of the world, institutions similar to Waqf are used as a financial institution. Researches and articles have been done in this regard, mostly in the form of examining the feasibility of examples of endowment of credit assets such as money, shares as part and example of securities and securities in its general sense, which includes shares and partnership bonds, only in terms of The possibility of endowment and the conditions of its authenticity or inauthenticity have been discussed. While the feature and innovation used in this article and the reason for this article is that, in addition to explaining the securities and its difference with the endowment of shares, the investigation of the endowment of securities in all its cases from two legal and economic points of view has been done together, while examining the ability Sahi waqf of securities, the economic benefits of this eternal act have been discussed according to the items and factors of economic rights, which has made the article special compared to other previous articles and researches. 3- METHODOLOGY In this article, the method of investigation and research based on study method along with deductive reasoning is used. 4- FINDINGS Based on the objectives of the research and the methodological approaches used in the research, the findings are presented in different parts. 1- The issue of securities as a subject that is intertwined with economic rights is involved in some disagreements. In spite of the fact that the common thread of all these debates is on the principle of waqf. However, in the conceptual explanation of some examples, there are differences of opinion. Since the economic evolution and transformation of societies has caused the evolution of economic markets, jurisprudence-legal analyzes should be in accordance with the issues and examples of the economic markets and respond to the needs of the society. 2- In de spite of the existence of some views for and against the endowment of securities, the main topic of this disparity of opinions is the dispute over ownership, objectivity, and the contradictions of benefiting from securities assuming the survival of the subject. 3- While examining the concept of securities and waqf and mentioning the arguments of the proponents and opponents, evaluating and analyzing the arguments presented, we have finally come to the conclusion that despite the fact that the conditions of the waqf are not defined in the Shari'ah, and based on the generality of the proofs of authenticity, while developing the concept of the same thing that nobles are not It also includes material and credit and considers the credit relationship of ownership to them as correct and on the other hand by justifying the endowment of securities by referring to the economic principles of reliance cost and the central outcome and based on works such as the role of endowment in reducing inequality and its importance in Productivity growth, from the point of view of economic rights, this endowment has the ability to be applied and implemented.   5- CONCLUSION In breif, it can be said that by considering the position of the endowment institution, the value and validity of securities in the modern economic system and paying attention to the effect of endowment on the subject of securities in relation to the economic rights of individuals in society, it is clear that jurisprudence rules emphasize the survival of the endowment or the imprisonment of its principal and the release of its benefits. They have different opinions. But it seems that they consider the survival of the principle correct in the case of usufruct. The document of the deniers of endowment of money is not a verse, narration or a practical principle. Rather, their opposition is only due to the fact that they believe that money is destroyed by usufruct and does not have the characteristic of being objective. Let it be like money that replaces the same money, and money will continue to exist as a result of its endowment despite the change of its object. In addition, from the point of view of economic rights, the realization and guarantee of individual interests is dependent on the guarantee and realization of collective interests, and progressive development implies a state in which individuals can enjoy inclusive growth and development, and this is only convergence in fair distribution.
