6The Contribution Of ‘ Urf To The Reform Of Islamic Inheritance Law In Indonesia

This library research explains the position of ‘urf as the basis for reforming Islamic law and its contribution to the renewal of inheritance law in Indonesia, using the content analysis method. The result showed that ‘ urf is of higher importance in the renewal of Islamic law and plays a very important role in reforming the inheritance law in Indonesia. Several KHI book II provisions were based on ‘ urf, including the inheritance of adopted children and adoptive parents, żawul ar ḥām , radd , walad , joint property, and substitute heirs. Among the several forms of ‘urf that have been recognized as Islamic law, ‘urf of joint property comes from the rich culture and traditions of native Indonesia. Therefore, it has made a valuable contribution to the renewal of Islamic law in Indonesia.

Mamak kepala waris  is the title name within a community whose role is to lead the whole community members, to handle, to manage, to observe and to be responsible to the community’s high ancestral inheritance. High ancestral inheritance is a property which owned by family member hereditary from woman side. This study aims to know the perspective of Islamic and custom law toward the position of  mamak kepala waris  in managing high ancestral inheritance in Minangkabau inhabitants. This study is an empirical juridical research with descriptive analysis methodology using comparative approach. The data were collected through observation, interview, and books, journals and laws theory. The result shows that the way  mamak kepala waris  manages the high ancestral inheritance is different with Islamic law. In Islamic law, theinheritance will be given to a son and daughter based on the Al-Qur’an and Hadiths. Meanwhile, the custom law in Minangkabau gives the inheritance to the woman lineage only.

12Expert System For Decision Support Division Of Inheritance According To Islamic Law

Develop an expert system as supporting legacy property distribution of decision which based on the Islamic law. This expert system expected can help everyone who need distribution value of legacy property by using distribution method based on the Islamic law. The legacy property value which will be distributed is legacy property after taken by the will if it was. And debt, corpse of administration cost. The distribution result is an percentage value for each heir who have right to get the property legacy after distribution process. Determination of nominal value of legacy property will not be count in this system. The user system can obtain nominal value of distribution property by multiplying the distribution percentage with whole value of legacy property. The result that taken form this expert system is output as information of heir group who has right to the legacy, and percentage value for each heir who has right to get the legacy. The inference method that used in this expert system is Forward Chaining Method. The method that used for system analysis and designing is Data Flow Oriented method by using Data Flow Diagram (DFD) tool. The database design is using Entity-Relationship Diagram (E-R Diagram) relation model.
