Series of translating prophet Mohammed sayings / book ( 36 ) / ( " All companions and Imams agree that if muslim intentionally kills a peaceful non muslim including christians and jews , he must not be killed and only pay the Diiah ( blood money ) , with examples of ( 50 ) companions & Imams " )   _ Author / Dr. Amer El-Husiny . Translated by / Amgd Al-Mansour   _ Imam Al-Bukhari tell in his book Al-Sahih ( 3046 ) about Ali Ibn Abi Talib that prophet Mohammed said , If a muslim intentionally kills a peaceful non muslim , the muslim must not be killed .   _ Imam Al-Tabarani tell in his book Al-Mu’gam Al-Kabir ( 18 / 111 ) about Imran Ibn Husain that a muslim man from tribe called Khuza’ah intentionally killed a peaceful non muslim man from tribe called Huzail . So , prophet Mohammed ordered not to kill the muslim because the killed one is non muslim , but he ordered him to pay the Diiah ( blood money ) .   _ In the previous book number ( 51 ) ( In Arabic series ) , I collected all prophet Mohammed sayings about the rules that must be applied on non muslims including christians and jews . ( It’s translated to english and contains ( 500 ) sayings )   One of these rules was not killing the muslim who intentionally kill a peaceful non muslim .   Then I collected the routes of this saying in a separate book number ( 52 ) ( In Arabic series ) and proved that it came by fourty ( 40 ) routes , and this number of routes makes it exactly like Quran . ( It’s also translated into English )   _ Then in this book I collect sayings of fifty ( 50 ) companions and Imams say and agree on this rule .   (( Note ( by the translator ) : To get the size or effect of the subject you must know that in Islam if a free muslim kills another free muslim , the killer must be killed .   But if the muslim kills another peaceful non muslim including christians or jews , the muslim must not be killed and he just pay the Diiah . So , the book talks about this difference specifically .   And saying ( if free muslim kill another free muslim ) , because the most companions and Imams say and agree that if free muslim intentionally kills a slaved muslim , the free one must not be killed . And the author also collected their sayings about that in another book number ( 212 ) in arabic series ))   ----------------------------------   __ There is another opinion said by very few Imams , they said that if muslim intentionally kill a non muslim , the muslim must be killed .   _ First of all , they are only three ( 3 ) Imams , Abu Hanifah and Al-Sha’bi and Al-Nakh’I . Imagine that there are literally hundreds of companions and Imams do not agree with them and say that they are completely wrong .   So if any one just even try to act by this opinion , you will find other muslims say no and you can not leave hundreds of prophet companions and Imams and just follow three men !   _ The second thing : Even those three Imams said that if muslim intentionally kill peaceful man temporarily living in Islamic countries , the muslim must not be killed .   To understand this , the peaceful non muslims are two types according to Islamic Shari’ah . One type who permanently live in Islamic countries . And the other types who temporarily live in Islamic countries like tourists , traders , and etc.   So those three Imams also agree with other Imams that if muslim intentionally kill a non muslim who temporarily live in Islamic countries , the muslim must not be killed . They just say that if he intentionally kills non muslim permanently live in Islamic countries .   They also said if muslim intentionally kill a type of christians called ( Magus ) , the muslim must not be killed !   And no one know what evidence they rely on to get these differences . All other companions and Imams did not say this . They all said if muslim intentionally kill any other muslim , permanently or temporarily live in Islamic countries , the muslim must not be killed .   _ The third thing : Those three Imams mentioned one saying of prophet Mohammed and said that he ordered to kill the muslim in this case . But this saying was reported by one man who called Ibn Al-Bailamani and he is a very weak memory man and forget a lot .   So , no one can rely on sayings that reported by a man like this . On the other hand , the sayings that order not to kill the muslim are reported by a lot of very trusted and very strong memory men . These are the sayings that you can rely on .   And they also said if the muslim accidentally kill another muslim , he must pay amount of money called Diiah . But if muslim accidentally kill a peaceful non muslim , he must pay only half of this Diiah .   Then , if a muslim intentionally kill a peaceful non muslim , the muslim must not be killed but he pay the full Diiah not only the half .   _ The fourth thing : Those three Imams said that the intended non muslim in this case is the non peaceful . But all other comapnions said to them you are completely wrong and prophet Mohammed never said that . But he said if muslim intentionally killed a peaceful non muslim . So imagine that in some countries they made it a rule if any one intentionally kill another one , the killer must be killed , except if the killed was muslim and in this case the killer must not be killed .   Will muslims say yes yes and this is not unjut and this is a very good rule ? Or theu they will say this is unjust and why do not all souls be equal and they will try by evey way to change this rule .   So when they make this rule , it’s fair and a very good rule . But when others make it and treat them by the same , they get angry and say this is unjust .   _ There might be more search and we must only follow the ways that bring peace to the worlds and make all souls equal to each other .

Then after moving to Al-Madinah , Allah changed that and ordered to kill all polytheists & atheists if they refuse to enter Islam )   _ Imam Ibn Aaqil tell in his book Al-Fonoun ( 1 / 390 ) ( Prophet Muhammed said that Allah ordered to kill all polytheists & atheists if they refuse to enter Islam . This means that the reason for killing them is that they do not believe in Allah and only Allah )   _ Imam Al-Tabari tell in his book Al-Tafsir ( 5 / 414 ) ( All muslims ( in the first three centures of Islam ) reported that prophet Mohammed ordered to kill all polytheists & atheists if they refuse to enter Islam . And he ordered to kill any muslim leaves Islam to any other religion . Also he ordered to not kill christians & jews if they pay Al-Giziah )   _ Imam Ibn Hazm tell in his book Al-Muhalla ( 4 / 414 ) ( Allah ordered to kill all polytheists and atheists if they refuse to enter Islam . Verse of Quran which says to not kill people if they refuse to enter Islam was said only in christians and jews , not in polytheists and atheists )   _ Imam Al-Shafi’I tell in his book Al-Omm ( 4 / 184 ) ( All polytheists and atheists must be killed if they refuse Islam . Muslims must fight them to force them to get into Islam and Allah ordered that in Quran )   ( He means verse ( 5 ) in Surat Al-Tawbah , ( You must kill all polytheists and atheists where ever you find them )   _ Imam Ibn Abi Hatim tell in his book Al-Tafsir ( 1089 ) that companion Ibn Abbas said ( All Quran verses that order to not kill peaceful polytheists & atheists if they refuse to enter Islam was only in the first of Islam .   Then Allah said this verse ( You must kill all polytheists and atheists where ever you find them ) and changed the past orders and made it a must to kill all polytheists and atheists if they refuse to enter Islam )   _ In previous book number ( 50 ) ( In arabic series ) , I collected all prophet Muhammed sayings that Allah ordered to kill all polytheists and atheists if they refuse to enter Islam , even if they were totally peaceful .   And in this previous book , I explained briefly that the order of not killing them was just in the first of Islam , then Allah changed that and ordered to kill them if they refuse to enter Islam , even if they are totally peaceful , because killing them is based on refusing to be muslims , not based on that they are peaceful or not .   _ In this book , I collect more of companions and Imams sayings about that . And they all say that not killing them was only in first of Islam ( when muslims had no power ) , then Allah changed that and ordered to kill all polytheists and atheists if they refuse to enter Islam .   ------------------------------------   __ Imam Malik Saying & opinion about this rule :   Imam Malik Ibn Anas says that all polytheists may not be killed if they pay Al-Giziah . So someone may say this is good , but wait for details .   First , Imam Malik as all other Imams agree that atheists or those who do not believe in Allah must be killed . They only must enter Islam .   Then polytheists , Imam Malik added one condition to accept Giziah from them and not killing them . This condition is to believe that Allah already sent Mohammed as prophet but not for all people .   Imam Malik says that if they say that , they can not be killed and pay Geziah and be treated like christians and jews . But if they say that Mohammed is not sent by Allah at all , they must be killed , according to Imam Malik .   Imam Ibn Hazm tell in his book Al-Muhalla ( 5 / 375 ) ( Imam Malik said if christians and jews say that Mohammed is a prophet but not for all people , they should not be killed if they already pay Al-Geziah and not say any thing bad about Ialsm or prophet Mohammed . But if any one says that Mohammed is not prophet at all , he must be killed )   So imagine if some people decided to act by this rule that Imam Malik said . How many people on earth from non muslims believe that Mohammed is a prophet but not for all people ? How many people will be killed if some people decided to apply this rule ?!   Also , there is another exception that is made by Imam Malik . He said that if someone is origanally from tribe Quraish or his great grandfathers from Quraish , he must be killed if he refuses to get into Islam , even if he was christian or jew . Quraish is a special case according to Imam Malik .   So when someone tell or report opinions of Imam Malik , he must report them by full opinion , not just parts of it .   (( Note ( by the translator ) : In Islam , the are four major Imams , and their schools are the most schools that muslims follow . They are : Malik , Shafi’I , Ibn Hanbal , Abu Hanifah . So Imam Malik is the head of one of the four major schools in Islam ))   -------------------------------------   __ Saying that these verses were said in wars :   Some new talkers said that verses that order to kill all polytheists and atheists were said in wars . You   must ask tough simple questions to those new talkers .   _ Ask them , what Allah said about these wars ? what he said about its endings ? Does he say that it must end when they become peaceful ? Or he said that the war will end only if they only enter Islam ? He did not say stop the wars upon them if they pay Al-Giziah like he said in christians and jews .   He ordered to stop fights and wars upon them only if they enter Islam . This clearly says that the purpose of this war is not to defend against someone insult you , but its purpose if to force them to enter Islam .   _ Then ask them , All companions and Imams knew these verses before . Why only you say that ?! None of them , not even one , said as that you says . Are all companions and Imams do not know the right Islam till you came today after over 1000 years to teach people about the right Islam !   Do you really think that all companions and Imams are ignorant people and do not understand Quran and do not know prophet’s sayings till you came after over ten centures to tell people about the right Islam ?!   _ Then ask them , When Allah sent these verses to prophet Mohammed , he already was in peace and had many peace treaties & covenants with many tribes . Then after Allah sent these verses , prophet Mohammed sent to those tribes that all peace treaties & covenants are void and they must enter Islam or he will make the war upon them and kill them .   So , this is very clear and strictly says that these verses were not just in wars , because prophet Mohammed was already in peace with a lot of them , then after these verses he cancelled the peace with them and ordered them to enter Islam or he will kill them .   _ Then ask them , Who said that even if the verses were sent during a war , it means that they are only in wars ? No companions or Imams said that . If a verse was sent during a war and Allah ordered to apply it generally , so it must be applied in war and not war situations .   As example , Allah prohibited that men and women can have intercourse outside marriage during a war in conquest of Mecca . Is this means that this action is only prohibited during war ?! No one said that and all say that this action is not allowed any time , in war or peace .   And also if an order was sent during a war , it does not mean that it’s only related to wars , but the order came general and Allah prohibited this action generally , so it became a general rule even if the order itself came during a war .   The time that verses were sent only gives information about the time of starting acting by them . So , these verses were general and not just in wars .   _ Some said that in some verses Allah said that some polytheists forced prophet Mohammed to get out of Mecca and this is the reason of wars . But this is absolute wrong because Allah ordered to kill them because they were polytheists , then he said that some of them also did other bad things .   As example , If a man committed stealing & adultery & killing , so he was killed as a punishment on killng , does this mean that adultery and stealing are not crimes and not require punishment ?! Of course not , because if he committed only stealing or only adultery , he will also be punished .   Another example , Allah ordered all muslims to do Salat because it will lead them to the right way and guide them away from the bad actions and sins . But if someone still does some bad actions or sins , does this mean that he is allowed to not do Salat ? Of course not , because whatever he does , he still must does the Salat .   So , those new talkers must know their place , they must know that companions and Imams are the most people know the right Islam . They are following exactly the orders of Allah and Quran and prophet Mohammed . Only you are the ignorants and you must learn from companions & Imams .   _ Also , you must know that polytheists themselves did not hurt prophet Muhammed and muslims in the first of Islam . But those polytheists told them to worship Allah as they want and let them practice Islam as they want whenever they want .   Also those polytheists told prophet Mohammed not to describe them by bad names as donkeys , foolish , pigs , animals , worse than animals , monkeys , unjust & eveil people , and etc. , Or they will fight him .   Even Abu Talib , uncle of prophet Mohammed , said to him that those polytheists were fair and just with him . But prophet Mohammed insisted on describing them by these names and telling that they and their fathers will be in Hell forever , and he was intruding on their sittings & councils to invite them to Islam . So , those polytheists started to defend against this and the fight between them started .   And I collected these sayings and Abu Talib sayings in book number ( 47 ) in this series ( In Arabic ) . And I collected Quran verses and propht Mohammed sayings about describing non muslims by these names , in a separate book number ( 46 ) of this series .   -------------------------------------   __ Quran verses that order to not fight people unless they start the fight :   Companions and Imams had three opinions about these verses . The first opinion that these verses were only in the first of Islam , then Allah sent other verses and ordered to kill all polytheists and atheists if they refuse to enter Islam .   The second opinion , that these verses were said about polytheists and atheists who agree to enter Islam , and christians & jew who agree to pay Al-Giziah . Allah says to not kill those people .   The third opinion , that these verses were said about women and children . Allah ordered to not kill them and take them among spolis as slaves .   But when you look generally to the three opinions , you will find that they all nearly agree on the same thing . Because the three opinions agree that polytheists and atheists must be killed if they refuse Islam .   And they all also agree to kill christians and jews who refuse to pay Al-Giziah , then taking their money & women & children as spoils . So , this is not a real difference or disagreement , because they all agree on the general rule .   ----------------------------------   __ Quran verses that tell that prophet Mohammed himself can not force all people to enter Islam :   Companions and Imams had different opinions about these verses . The first one is that these verses were sent in first of Islam , then Allah changed that and sent other verses that order to kill all polytheists & atheists if they refuse to enter Islam .   The second opinion that these verse tell prophet Mohammed that he alone can not force all people to enter Islam . As example , prophet Mohammed will not be able to make all people stop stealing , adultery , injust , killing , and etc. But this does not mean to not punish people who do these things .   So by the same , Allah tell prophet Mohammed that there will still be people who refuse Islam and choose to be polytheists and atheists . But this does not change the action that must be made on them .   In simple words , these verses talk only about the human ability of prophet Mohammed , and that he can not do these orders alone .   _ Imam Al-Tabari tell in his book Al-Tafsir ( 15 / 212 ) that companion Ibn Abbas said ( Prophet Mohammed wanted to make all people enter Islam and follow him , but Allah sent verses to him and told him that he can not do that alone by himself and Allah only can do that and Allah can guide whoever he wants to Islam )   _ Also , if you look to these two opinions generally , you will find that they all agree on the same result . They all agree that prophet alone can not force all people to Islam . But they also agreed that all polytheists and atheists must be killed if they refuse to enter Islam .   -----------------------------------   __ Quran verses that tell to not force people to enter Islam :   Companions and Imams had three different opinions about these verses . The first opinion , that these verses were in the first of Islam only , then Allah changed them and sent other verses and ordered to kill all polytheists and atheists if they refuse to enter Islam .   The second opinion , that these verses prohibit to force people to do wrong things or sins , but it is ok to force them to enter Islam and do good things and leave the sins .   The third opinion , that these verses were sent about christians and jews , and they must not be killed if they agree to pay Al-Giziah and obey general Islamic rule .   But also again , if you look generally to these opinions , you will find that they agree on the final result , and they all agree that polytheists and atheists must be killed if they refuse to be muslims .   ----------------------------------   __ Quran verses that tell that it’s ok to be good with peaceful people :   Companions and Imams had three opinions about these verses . The first opinion , that these verses originally talk about muslims , and these verses order muslims to be good with other peaceful muslims , and these verses do not talk about non muslims at all .   The second opinion , that these verses were sent about polytheists and atheists but only in first of Islam when muslims had no power . Then after moving to Al-Madinah , Allah changed that and ordered to kill all polytheists and atheists if they refuse to enter Islam , even if they were totally peaceful .   The third opinion , that these verses were sent about christians and jews , not the polytheists and atheists .   _ But also if you look generally to these three opinions , you will find that they all agree on the final result , that these verses are not about polytheists and atheists , and they must be killed if they refuse to enter Islam .   ----------------------------------   __ Prophet Mohammed sayings to treat Al-Magus as christians and take Al-Giziah from them :   A lot of Imams considered these sayings another proof that polytheists and atheists must be killed if they refuse to enter Islam . Because Omar Ibn Al-Khattab ordered to kill some people called Al-Magus , but another companion told him that prophet Mohammed ordered to take Al-Giziah from them .   So , if he was only killing the non peaceful , why he wanted to kill Al-Magus , despite being peaceful ? Because he thought that they were type of polytheists and companions were killing all polytheists .   But only when another companion told him that prophet Mohammed said that they are type of christians , Omar did not kill them and took Al-Giziah from them .   This is a very straight clear example that prophet Mohammed companions were killing all polytheists and atheists if they refuse to enter Islam , even if they were totally peaceful .   ------------------------------------   __ Note about lying in transfer some sayings :   Some people lie on some Imams and transfer their sayings in a way that totally change the meaning . And I will just mention an example that will make the idea clear .   Imam Makki Ibn Abi Talib tell in his book Al-Hidaiah ( 11 / 7423 ) ( You should be good to non muslims even if he was polytheist and do not kill him )   See where I stop ? So you will think that he said to not kill polytheists and be good to them , right ?   But let’s see the rest of his words and see if the meaning will change : He said ( You should be good to non muslims even if he was polytheist and do not kill him untill you invite him to enter Islam then kill him if he refuses )   See the meaning now ? Do you still think that he says to not kill polytheists and be good to them as in the first example ? So , you must be very aware about those who lie on companions and Imams and tranfer their sayings in ways that totally change the meaning .   -----------------------------------   __ This what made some people talk about this rule :   _ Some said , when you tell some people enter Islam or you will be killed , what do you expect . Do you expect that they will stand in one line to butcher them one after one . Or that they will stand with each other to fight against you . What if this was made worldwide .   And also they will say that they did not start fight and they did not attack you , but you are the one who started the fight and you are the one who threatened people by killing if they do not believe in your religion . And this already happened in many of the previous wars .   _ Some also talked about forced people who entered Islam . When you force someone to enter your religion or he will be killed , and he responds to you and enter your religion , how can you tell that he is convinced .   You tried to talk to them to enter Islam many many years and they refused . But suddenly when you threaten by killing , they entered Islam . This is not convincing .   And in history , there are some sayings of comapnions that the hypocrites were one third ( 1/3 ) of people in Al-Madinah . They were muslims just to not be killed .   _ Some muslims said that all polytheists & atheists are immorals and unjust people , that’s why they must be killed . But others answered on that by sayings that every religion on earth has immoral and unjust people , even in Islam , even among prophet Mohammed companions themselves .   A lot of islamic Imams and comapnions reported that some prophet’s comapnions committed stealing , adultery , killing , etc. And there is a famous example in islamic books of Sunan , that a prophet Mohammed’s comapion stole some money from another comapion .   So , they took this man to prophet . Prophet Mohammed ordered him to swear to Allah that he did not steal , so he did . Then prophet Mohammed said that he is a liar and thief , but Allah forgave him because he is faithful muslim .   So , this is not an ordinary man but one from companions of prophet Mohammed . And he committed stealing and lying , and even in front of prophet Mohammed face to face . So , is there any factor left over to be religious ? and yet he committed stealing and lying .   Also another example , a man called Al-Ru’asi ( one of prophet Mohammed comapnions ) and his tribe attacked another tribe and killed their men and did bad things with their women ( The meaning is known ) . Then they came to prophet Mohammed and asked Allah for forgiveness , so Allah forgave them .   So , they also are not random people , but they from comapnions of prophet Mohammed . And yet they committed killing and adultery .   And on the other hand , there are many non-muslims even polytheists that do not commit stealing or killing or any thing like that and some of them do not even hurt animals . This is a fact that all people see it in real life .   And it’s not just a fact , but prophet Mohammed himself said it . When some companions asked him about some non-muslim and polytheist people who were doing a lot of charity and good works then they died , are Allah will forgive them and enter them to Heaven ? He said no because they did not believe in him .   Also prophet Mohammed said that there were some alliances between polytheists , like Hilf Al-Fodoul & Hilf Al-Mutaiiabin & Hilf Bani-Hashim & others . They united together to fight against unjust people .   _ Some muslims said that these sayings are not proven to prophet Mohammed . But others answered on that by sayings that all of his companions reported these sayings about him . All islamic Imams agreed on these sayings and rules .   There are literally hundreds of trusted ways to these sayings . Are these people will say that all prophet comapnions and Imams do not know Islam until some people came after over 1000 years to tell people about the right Islam ! Those are just people who create an imaginary version of Islam in their heads to satisfy themselves .   _ Some said that there are some Quran verse say that you should not force some people to enter Islam . But others answered on that by sayings that these are old rules in Mecca ,   then after moving to Al-Madina Allah ordered prophet Mohammed by new rules . So the old rules are void . Also some Imsms say that these Quran verses were said in christians and jews , not in polytheists and atheists .   (( Note ( by the translator ) : In Islam , rules changed over the years of prophecy of prophet Mohammed . In more simple words , something may be allowed today then tomorrow Allah prohibit it , and vice versa . And Muslims are ordered to follow tha last order or rule .   As example , if something was allowed yesterday then Allah prohibited it today , so it’s prohibited . And if something was prohibited yesterday then Allah allowed it today , so it’s allowed . There is an islamic term for this which is ( Al-Nasikh and Al-Mansoukh )   From examples of that , The Salat , there were only two Salat in first of Islam , then after many years it became five Salat . Can any muslim today say that the Salat is only two not five ?! Of course not , because the last rule made it five not two .   Also as example , the alcohol or wine , it was allowed in first of Islam , then after fourteen years it became Haram and prohibited .   Even if someone was still drinking it and refused to quit it , prophet Mohammed oerdered to kill him . Can anyone say that alcohol is allowed today because it was allowed for ( 14 ) years ?! Of course not , because the last rule made if Haram and prohibited .   So , the orderes that prophet Mohammed said in his last years were the last orders and did not change by other orders after that .   And this is the key in this rule . When someone tells you that there are some Quran verses that prevent killing non-muslims , tell him this rule . Killing polytheists and atheists were not allowed in the first of Islam , when prophet Mohammed had no power or army .   But after moving to Al-Madinah and had an army , he said that Allah ordered him to kill all polytheists and atheists if they refuse to enter Islam ))   _ Some muslims said that there were already some wars between people at this time . But others answered on that by sayings there is a huge difference between some people doing something and saying that God ordered you to do it or he will punish you in Hell forever , and some people say or do some things by themselves .   In this second type , you always can say they are worng and no one should follow them , you can even fight them . But when they say God ordered us to do that and if people do not obey he will punish them in Hell forever , you can not easily say no and this is a completely different situation .   __ Finally , there might be more details and search in these situations .
